Better Days Travel is acting as a mere agent for SUPPLIERS (identified on the final travel documents) in selling travel-related services, or in accepting reservations or bookings for services that are not directly supplied by Better Days Travel (such as air and ground transportation, hotel accommodations, meals, tours, cruises, etc.). Better Days Travel, therefore, shall not be responsible for breach of contract, failure to comply with any laws such as the Americans with Disabilities Act (ADA), or any intentional or negligent actions or omissions on the part of such suppliers, which result in any loss, damage, delay, inconvenience or injury, or death to travelers or travelers' companions or group members. Unless the term "guaranteed" is specifically stated in writing on your tickets, invoice, or reservation itinerary, Better Days Travel does not guarantee any of such supplier's rates, bookings, reservations, connections, scheduling, or handling of baggage or other personal effects. Travelers have done due diligence, are aware of the quality of the hotel accommodations chosen, and agree that Better Days Travel will not be responsible if they are not satisfied.
2. Risks, Cancellation, and Insurance
Traveler assumes complete and full responsibility for, and hereby releases Better Days Travel from, any duty of checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety and security conditions of such destinations, during the length of the proposed travel. However, we specifically recommend that U. S. Citizens traveling internationally, including travel to Canada, Mexico or the Caribbean, do so with a valid U. S. Passport. Better Days Travel shall not be responsible for any injuries, losses or damages in connection with terrorist activities, social or labor unrest, mechanical or structural integrity of air, sea, and ground transportation and accommodations, diseases, local laws, terrorist acts, climatic conditions, Acts of God, delays, changes or cancellation of travel due to weather conditions, hotel services, accidents or health related problems before or while in-transit to (e.g., an accident on the way to a tour), during, and after a tour, or any other actions, omissions, or conditions outside of Better Days Travel’s control.
If travel plans are delayed or cancelled for any reason there will be no refunds issued by Better Days Travel, except in those circumstances where Better Days Travel has issued its own schedule of cancellation, applicable to all or a portion of a booking (whenever such a schedule is issued, it will specifically indicate which trip component(s) it is issued for and it will apply ONLY to the specific trip component(s) indicated). Please note that a ‘trip’ or ‘booking’ often consists of multiple components, each of which may carry its own cancellation penalties (example: an airline ticket, a pre-trip hotel night, a multi-day adventure vacation by a tour operator, a post-trip extension designed by Better Days Travel, all of which may be subject to a different set of cancellation policies). You will be provided with the individual cancellation policies to the extent that these are available in a distributable format, for your records, but Better Days Travel is not responsible for this policy distribution. Clients are responsible for obtaining the applicable policies, either by contacting Better Days Travel and requesting a copy (if available, otherwise it will be verbal delivery) or by consulting the individual suppliers and/or their catalogs. No refund(s) will be issued for cancellations due to actual or threatened terrorist events. Furthermore, there will be no refunds due to fear of travel from actual or threatened terrorist, health, political or other similar events.
It is the traveler’s responsibility to protect their purchases and Travel Insurance is strongly recommended. Traveler is advised to obtain appropriate insurance coverage against these risks; information is available through Better Days Travel regarding travel insurance. Traveler's retention of tickets, reservations, or bookings after issuance shall constitute consent to the above and an agreement on his/her part to convey the contents hereto to his/her travel companions or group members.
By embarking upon his/her travel, the traveler voluntarily assumes all risks involved in such travel, whether expected or unexpected. Traveler is hereby warned of the above risks as well as possible travel industry bankruptcies and medical and climatic disruptions, and the possibility traveler may be unable to travel as scheduled because of personal emergency.
I acknowledge that I have been made aware of the benefits of travel insurance and authorize the purchase thereof by signing this form and/or all credit card authorization forms issued to me which include the purchase of travel insurance. I also hereby agree to sign the Travel Insurance Refusal form (available from Better Days Travel on request) should I for some reason wish to not purchase travel insurance.
Price quotes are applicable to the date and time at which they are requested. Quotes in foreign currency are subject to fluctuations in exchange rates and International credit card issuer fees. Better Days Travel is not responsible for any increases due to fuel surcharges, government-imposed taxes/fees or supplier-imposed increases.
4. Check-in & Departure Responsibilities
It is strongly recommended that you check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure for international flights. * It is the traveler’s responsibility to reconfirm flight times at least 24-72 hours prior to scheduled flights. Better Days Travel will not assume responsibility for any air or schedule changes. Certain countries require departure taxes that require payment in cash. *Recommended check in times are subject to change without notification. It is the traveler’s responsibility to remain abreast of changes in condition or airport rules that might require earlier arrival times. This information can be found when entering your confirmation number on the airline website.
5. Additional Disclosure
Better Days Travel is not the source or supplier of the travel services requested and acts solely as a booking agent for disclosed principal supplier cruise lines, hotels, airlines, ground transportation and other companies providing accommodations, transportations, and/or other services. Each of these suppliers is an independent entity with its own management and is not subject to the control of Better Days Travel. Better Days Travel shall not be liable for any accident, injury, property damage or personal loss to client or to those traveling with Client in connection with any travel services we have booked, including but not limited to acts of God, weather conditions, natural disasters, acts of governments or other authorities, wars, civil disturbances, riots, strikes, epidemics, acts of terrorism, breakdown in equipment, theft, delay, fuel increases or cancelation or change in itineraries or schedules. I acknowledge and accept that there are cancelation policies, change fees and penalties that apply to my travel plans and services as set by travel suppliers. If for any reason my credit card charges are later declined, reversed or Better Days Travel is unable to receive payment for the travel plans and services, I acknowledge that this is a binding contract and Better Days Travel will be entitled to recovery, including reasonable attorneys’ fees in connection with collection.
You agree to waive all claims for special, indirect, or consequential damages. You agree to indemnify and hold us harmless from and against our liability to third parties (including your guests and companions) arising from you or your guests' or companions’ actions or omissions. YOU AGREE THAT OUR MAXIMUM LIABILITY TO YOU WILL NOT EXCEED THE AMOUNT YOU HAVE PAID US. Changes to this agreement must be made in writing and signed by both you and us.
Once we have completed the services described herein, this agreement will terminate automatically, except with respect to limitations on our liability and with respect to your indemnity.
Any dispute related to this agreement shall be governed by Florida law without regard to conflict of laws or principles. You agree that the courts in Volusia County, Florida, will be the exclusive jurisdiction for all claims brought by you or Better Days Travel, and you hereby submit to the personal jurisdiction of those courts.
By paying the planning fee and/or deposit, I have read and accept the Terms & Conditions set forth by Better Days Travel on behalf of myself and anyone in my party.
